PROVISIONS SPECIFIC TO .ADULT REGISTRATIONS
ICM Registry PN LLC ("Registry Operator") is the registry operator for the .ADULT TLD.
Indemnification. You agree to indemnify, defend, and hold harmless Registry Operator and its subcontractors, and the directors, officers, employees, affiliates and agents of each of them, from and against any and all claims, damages, liabilities, costs, and expenses, including reasonable legal fees and expenses, arising out of or relating to your domain name registration. This indemnification obligation will survive termination or expiration of the Agreement.
Compliance with Terms and Conditions. You agree to comply with each of the following requirements:
- ICANN standards, policies, procedures, and practices as may be adopted or amended from time to time;
- Operational standards, policies, procedures, and practices for the .ADULT TLD established from time to time by Registry Operator; and
- All Public Interest Commitments set forth in Specification 11 to the Registry Agreement, as amended from time to time by ICANN or registry operator.
Policies. You agree to the terms of Registry Operator's Anti-Abuse Policy and other policies as posted on the Registry Operator Website. Without limiting the generality of the foregoing, you agree to all Registry Operator policies, procedures, and practices for its Limited Registration periods, referred to as both the "Sunrise B Program" and the "Domain Matching Program". For the purpose of both the Sunrise B Program and the Domain Matching Program referenced in this section, available second level domain names are domain names in the .ADULT TLD that are available after the Registry TLD TMCH Sunrise Period and that are not reserved by Registry Operator for any reason, including without limitation for the .ADULT TLD Premium Name list. At all times, Registry Operator retains the full rights and ability to correct any mistakes and/or errors.
Disqualification. You agree to Registry Operator's right to disqualify registrations as set forth in Specification 11 to the Registry Agreement.
GAC Safeguards. You agree to any and all applicable Government Advisory Committee ("GAC") safeguards, as set forth in the Registry Agreement and/or as posted on the Registry Operator Website, or as otherwise communicated to you from time to time.
Personal Data. You consent to the use, copying, distribution, publication, modification, and other processing of your personal data by Registry Operator and its designees and agents.
Initial Launch. You agree to be bound by the terms and conditions of the initial launch policies of the .ADULT TLD as published by Registry Operator from time to time on the Registry Operator Website, including without limitation any Sunrise period, Limited Registration period, Sunrise B Program, Domain Matching Program, and the dispute resolution policies and rights protection mechanisms managed by ICANN or Registry Operator for the .ADULT TLD (including without limitation to the Trademark Clearinghouse), and further acknowledge that Registry Operator has no liability of any kind for any loss or liability resulting from the proceedings and processes relating to the Sunrise period, Limited Registration period, Sunrise B Program, Domain Matching Program, or other period associated with the initial launch of the .ADULT TLD, including, without limitation : (a) the ability or inability to obtain a domain name during these periods, (b) refunds or credits from Registry Operator for any errors or mistakes caused by any registrar, and (c) the results of any dispute resolution process regarding a domain name registration.
Registry Operator's Reservation of Rights. You acknowledge and agree that Registry Operator reserves the right to deny, cancel, or transfer any registration or transaction, or place any domain name(s) on registry lock, hold, or similar status, that it deems necessary, in its discretion: (i) to protect the integrity and stability of the .ADULT TLD or the registry system; (ii) to comply with any applicable laws, government rules or requirements, requests of law enforcement, or any dispute resolution process; (iii) to avoid any liability, civil or criminal, on the part of Registry Operator, as well as its affiliates, subsidiaries, officers, directors, employees, and contractors; (iv) for violations of the Agreement, including, without limitation the Anti-Abuse Policy as well as any exhibits, attachments, or schedules thereto; (v) for violations of this registry-registrar agreement, including, without limitation, any exhibits, attachments, or schedules thereto; (vi) for the non-payment of fees; or (vii) to correct mistakes made by Registry Operator or any registrar in connection with a domain name registration. Registry Operator also reserves the right to place a domain name on registry hold, registry lock, or similar status during resolution of a dispute.
Order of Precedence. If there is a discrepancy between the terms required by these additional provisions and the terms of the Agreement, the terms of these additional provisions shall supersede those of the Agreement.
